Welcome to bestay. By accessing or using our platform, you agree to the following Terms and Conditions. These Terms govern your use of the bestay platform ("Platform") for booking villas and other related services. Please read them carefully.


1. General Use of the Platform


1.1. By using the Platform, you confirm that you are at least 18 years old or have the legal capacity to enter into binding agreements under the laws of Singapore and Indonesia.


1.2. You agree to provide accurate, current, and complete information during the registration and booking process.


1.3. You are responsible for maintaining the confidentiality of your account and password.


1.4. The Platform facilitates bookings between you and the property owners or managers. Bestay acts solely as an intermediary and is not a party to the rental agreements between you and the property owner.


2. Personal Information and Data Usage


2.1. bestay collects and processes personal information in compliance with Singapore's Personal Data Protection Act (PDPA) and Indonesia’s Data Protection Regulations. For details, please refer to our [Privacy Policy].


2.2 By using the Platform, you consent to the collection, storage, and processing of your personal data for purposes related to booking, payment processing, and improving our services.


2.3 bestay will not sell, rent, or share your personal information with third parties without your explicit consent, except as required by law.


3. Booking and Payment Terms

3.1. All bookings made through the Platform are subject to availability and confirmation from the property owner or manager.

3.2. Payment must be made in accordance with the payment terms outlined during the booking process. Failure to comply may result in cancellation of your booking.

3.3. Any additional charges, including but not limited to cleaning fees or taxes, will be disclosed during the booking process.

3.4. Failure to complete the payment in full and on time will result in the cancellation of the reservation. Partial payments or delayed payments may also lead to forfeiture of the booking without entitlement to a refund.

3.5. By completing the booking, you acknowledge and accept responsibility for providing accurate payment details and ensuring that sufficient funds are available for the transaction.

3.6. All payments must be made through the payment methods provided on the Platform. Payments made outside the Platform are not authorized and may result in the loss of your booking and funds.


4. User Responsibilities


4.1. Compliance with Property Rules: You agree to comply with all rules, regulations, and guidelines set by the property owner or manager, including but not limited to check-in/check-out times, noise restrictions, and guest limits.

4.2. Responsibility for Damages: You are responsible for any damage caused to the property during your stay. The property owner or manager reserves the right to charge you for the cost of repairs or replacements.

4.3. Prohibited Activities: You may not use the Platform or properties booked through it for unlawful purposes. Any behavior at the property must comply with the laws of the jurisdiction where the property is located. You are forbidden from conducting illegal activities, and bestay bears no legal responsibility for any unlawful behavior by users.


5. Limitation of Liability


5.1. Personal Damages: bestay is not responsible for personal injuries, losses, or damages incurred during your stay at any property. Travelers are advised to obtain travel insurance for additional protection.

5.2. Service Disruptions: bestay will not be liable for interruptions or unavailability of the Platform due to technical issues, maintenance, or circumstances beyond our control.

5.3. Third-Party Liability: bestay is not liable for disputes, damages, or losses arising from your relationship with the property owner or manager.


6. Cancellation and Refund Policy


6.1. Cancellation and refund terms are governed by the specific policies of the property you book. These will be disclosed to you during the booking process.

6.2. Bestay reserves the right to mediate disputes between users and property owners; however, resolution is not guaranteed.


7. Intellectual Property

7.1 All content, trademarks, and materials on the Platform are the property of bestay or its licensors. You may not copy, distribute, or modify any part of the Platform without prior written consent.


8. Governing Law and Jurisdiction

8.1. These Terms and Conditions are governed by the laws of Singapore. In the event of a dispute, you agree to submit to the exclusive jurisdiction of the courts in Singapore.

8.2. All behavior and activities within the property must comply with local laws where the property is located. bestay disclaims all liability for any unlawful activities conducted by users.


9. Amendments to Terms


9.1. bestay reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting on the Platform. Continued use of the Platform constitutes your acceptance of the revised Terms.


10. Property Rules for BaliSuperHost-Managed Villas


10.1. Arrival and Departure Policies

- Standard check-in time is at 3:00 PM. Early check-in is available upon request, subject to prior guest departure times and space availability. Luggage storage is available after 12:00 PM.

- Late check-in after 8:00 PM incurs a surcharge of IDR 200,000 Nett, payable in cash or via bank transfer to BaliSuperHost's designated account.

- Standard check-out time is at 11:00 AM. Late check-out may be accommodated based on upcoming reservations. Luggage storage is available until 12:00 PM; beyond this, a recommended storage partner may be used at additional costs.

- Late Check-Out Fees:

* Up to 12:00 PM: Free

* Between 12:00 PM and 6:00 PM: 50% of the daily rate

* After 6:00 PM: Full daily rate

- Specific check-in/check-out policies may vary by property.

10.2. Occupancy Policies

- The standard occupancy is 2 persons per bedroom. Additional guests are allowed up to (2 persons x number of bedrooms) + 2, within the absolute maximum capacity, with prior notice and applicable fees.

- Extra guest fees depend on villa-specific policies and guest age. Notify us promptly of any changes to ensure fire safety and adequate amenities.

- Failure to adhere to occupancy limits may result in denied access or reservation cancellation without compensation.

10.3. Pets Policies

- Well-behaved pets are welcome in select villas, subject to an additional security deposit payable at check-in. Guests must inform bestay in advance.

- Cleaning charges will apply for any pet-related mess found during check-out.

- Pets are not permitted in bedrooms or restricted villa areas.

- Some villas may have a no-pets policy, which must be respected.

10.4. Safety and Security Policies

- Guests are responsible for their safety and must supervise children, especially in swimming pools or areas with potential hazards.

- BaliSuperHost-managed villas are equipped with CCTV installation, fire extinguishers in accessible locations, smoke alarms in key areas, and compliance with mandatory motorbike helmet and car seatbelt laws.

- In-room safes are provided for secure storage of valuables.

10.5. Damages and Breakages

- Guests are liable for damages caused during their stay. Significant damages or violations will result in deductions from the security deposit.

- Missing room keys will incur additional replacement charge.

10.6. House Rules and Prohibited Activities

- Noise should be minimized after 8:00 PM. Parties or loud activities require prior approval from local authorities.

- Smoking is prohibited inside bedrooms and allowed only in designated open spaces where ashtrays are provided.

- The following activities are strictly prohibited:

* Use or possession of narcotics or psychotropic substances

* Recording nudity for social media or engaging in illegal activities

* Conducting unauthorized commercial activities

10.7. Use of Villa Services

- To ensure quality and safety, guests are encouraged to use services such as transport, spa, and chef provided by BaliSuperHost’s trusted partners. Use of third-party vendors for in-villa activities incurs a surcharge of IDR 2,000,000 Nett, and prior approval is required.

10.8. Liability and Indemnity

- Guests agree that BaliSuperHost-managed villas are not liable for accidents occurring during the use of unsupervised villa facilities such as swimming pools.

- Guests must report any accidents, injuries, or emergencies to villa staff immediately and provide written notice within 24 hours of check-out for compensation or claims.

- The villa’s responsibility for assistance ends after the guest completes check-out.
